Summary Terms and Conditions

Visit www.rakutenfans.com, fill in the online form, and follow the instructions to send a message showing your support to your Davis Cup Team or general support to be entered into the Campaign. No purchase is necessary. Rewards: The first 10,000 entrants will get to have their submitted message featured in the fan zone areas located in the 2022 Davis Cup Finals host cities (Bologna, Glasgow, Hamburg, Malaga, and Valencia). Submitted messages will be displayed from 13 September 2022 to 18 September 2022 (Bologna, Glasgow, Hamburg, and Valencia), and from 22 November 2022 to 27 November 2022 (Malaga). The message submission period will be between 07/09/2022 – 27/11/2022 or until the number of maximum entries is reached, whichever event occurs first. Full Terms and Conditions

  1. This campaign is open to entrants who are aged 18+ or over the age of majority in their country of residence, whichever is higher. Messages of minors are permitted if their legal representative expressly authorizes it by clicking on the corresponding checkbox.
  2. Entrants must ensure that their participation is lawful in accordance with the laws of the country of residence. This Campaign is void where void under local national laws. The Promoter makes no representations, express or implied, as to the lawfulness of any individual’s participation or as to any other aspect of any Campaign.
  3. No purchase is necessary; however, Internet access and a valid email address are required. The Promoter is not responsible for internet access or the validity of the email address.
    Campaign Period: Enter between 12:00 CET on 7 September 2022 and 12:00 CET on 27 November 2022 or until 10,000 entries are received, whichever event occurs first.
  4. To Enter: Visit www.rakutenfans.com and then:
    1. Fill out the entry form with your personal details (name, country of residence, and email) as required.
    2. Choose who you want to support (a Davis Cup team or general support to the event).
    3. Select a message (20 options shown of the 50 options available) which will be automatically approved without the moderation process. Printing of messages is subject to availability.
    4. Accept the Terms & Conditions and the Privacy Policy.
    5. Submit the message. Once messages are submitted no retraction.
  5. The Rewards:
    1. The first 10,000 entrants will get to have their submitted message featured in an Art Installation shown in the Davis Cup exhibition Art Installations. All messages will be shown at the fan zone areas in the 2022 Davis Cup group stage host cities (Bologna, Glasgow, Hamburg, and Valencia) according to the selected team. All messages will be shown at the fan zone area in the 2022 Davis Cup knock-out stage host city (Malaga) according to the selected team.
    2. For the opportunity to win other prizes or rewards related to the 2022 Davis Cup it will be necessary to participate by entering one of the following links, in which other T&Cs and Privacy Policy will apply:

  6. In the instance that the target of 10,000 entries is not achieved by the end of the campaign, the art installations will be built with the number of entries received within the entire duration of the campaign. This may result in the duplication of some messages. This will not change nor affect by any terms the participation of the users.

  8. The Promoter reserves the right to cancel the Campaign at any time.
  9. The Promoter reserves the right to reject NAMES which, in the reasonable opinion of the Promoter:
    1. contain any content that is likely to be considered offensive by the Promoter or could reflect negatively the name, reputation, or goodwill of the Promoter or any brand partner;
    2. defame, misrepresent, or insult other people or companies, including, but not limited to the Promoter (including its partners);
    3. promote any political agenda;
    4. contain defamatory, malicious, indecent, or other inappropriate content including sexist or racist language;
    5. include the names, or similar of any individual without their express permission;
    6. contain immoral or obscene behavior;
    7. condone or encourage violent or anti-social behavior;
    8. cause offence on the ground of religion, gender, sexual orientation, nudity, disability, or age;
    9. contain or refer to any third-party brand or reference any third-party names, and/or trademarks other than the Promoter and Davis Cup; or
    10. represent a danger to health and safety or cause fear or distress.
  10. The Promoter will not be liable for any failure to comply with its obligations caused by reason of Force Majeure including (but not limited to) weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, or any other circumstances beyond the control of the Promoter.
  11. In the event that the Campaign cannot be run as planned for reasons including but not limited to tampering, unauthorized intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter that corrupt or affect the administration, security, fairness, integrity or proper conduct of this Campaign, the Promoter reserves the right to disqualify any individual who tampers with the entry process or does not comply with these Terms & Conditions and to cancel, modify or suspend the Campaign or invalidate any affected entries.
  12. No responsibility can be taken for entries that are lost, delayed, corrupted, damaged, misdirected, or incomplete or which cannot be delivered for any technical, delivery, or other reason. Proof of sending will not be accepted as proof of receipt. The Promoter does not guarantee continuous or secure access to the entry website.
  13. The Promoter together with any associated agencies and companies, including the Davis Cup, will not be liable for any cost associated with the Entrant’s participation or any loss (including, without limitation, indirect, special, or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Campaign, except for any liability which cannot be excluded by law. Nothing will exclude the Promoter’s liability for death or personal injury as a result of its negligence. For the sake of clarity, Rakuten is the promoter of this Campaign and the Davis Cup will not be held liable or assume any responsibility in relation to any claim from any third party arising as a consequence of the Campaign, which will be assumed by Rakuten in accordance with these Terms and Conditions.
  14. Bulk entries from trade, consumer groups, or third parties will not be accepted. Entries submitted by macros or other automated means will not be counted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that participant’s entries into the Campaign, that participant’s entries will be disqualified. Entrants are not permitted to enter using anonymous email services such as, but not limited to, GuerillaMail, Disposable, or Mailinator.
  15. Should an act, omission, event, or circumstance occur which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms & Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligations.
  16. Any and all personal data supplied for the running of this Campaign will be used solely for the purpose of this Campaign by the Promoter and/or by any agent appointed by it to assist with running the Campaign on behalf of the Promoter and will not be disclosed to a third party for any other purpose unless the participant’s positive consent has been obtained.   17. If any provisions of these Terms & Conditions are judged to be invalid, illegal, or unenforceable, this will not affect or impact the continuation in full force and affect the remainder of the provisions.
  18. By entering this Campaign, all participants will be deemed to have agreed to be bound by these Terms & Conditions.
  19. In the event of a discrepancy between these Terms & Conditions and the details in any promotional material, the details in the Terms & Conditions will prevail.
  20. These Terms & Conditions are governed by Spanish law and their interpretation and application will be subject to the exclusive jurisdiction of the courts of Spain.
